Ambulance Seva (Customer Terms and Conditions)
PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE SERVICES.
Your access and use of the Services constitutes your agreement to be bound by these Terms, which establishes a contractual relationship between you and Ambulance Seva. If you do not agree to these Terms, you may not access or use the Services. These Terms expressly supersede prior agreements or arrangements with you. Ambulance Seva may immediately terminate these Terms or any Services with respect to you, or generally cease offering or deny access to the Services or any portion thereof, at any time for any reason.
Supplemental terms may apply to certain services, such as policies for a particular event, activity or promotion, and such supplemental terms will be disclosed to you in connection with the applicable services. Supplemental terms are in addition to, and shall be deemed a part of, the terms for the purposes of the applicable services. Supplemental terms shall prevail over these terms in the event of a conflict with respect to the applicable services.
Ambulance Seva may amend the Terms related to the Services from time to time. Amendments will be effective upon Ambulance Seva’s posting of such updated terms at this location or the amended policies or supplemental terms on the applicable service. Your continued access or use of the services after such posting constitutes your consent to be bound by the terms, as amended.
The services constitute a online platform that enables users of Ambulance Seva’s mobile applications provided as part of the Services to arrange and schedule transportation and/or logistics services with independent third party providers of such services, including independent third party transportation providers and independent third party logistics providers under agreement with Ambulance Seva or certain of Ambulance Seva’s affiliates (“Third Party Providers”). YOU ACKNOWLEDGE THAT Ambulance Seva DOES NOT PROVIDE TRANSPORTATION OR LOGISTICS SERVICES OR FUNCTION AS A TRANSPORTATION CARRIER AND THAT ALL SUCH TRANSPORTATION OR LOGISTICS SERVICES ARE PROVIDED BY INDEPENDENT THIRD PARTY CONTRACTORS WHO ARE NOT EMPLOYED BY Ambulance Seva OR ANY OF ITS AFFILIATES.
User Accounts:
In order to use most aspects of the Services, you must register for and maintain an active personal user services account. You must be at least 18 years of age, or the age of legal majority in your jurisdiction (if different than 18), to obtain an account. Account registration requires you to submit to Ambulance Seva certain personal information, such as your name, address, mobile phone number and age, as well as at least one valid payment method (either a credit card or accepted payment partner). You agree to maintain accurate, complete, and up-to-date information in your account. Your failure to maintain accurate, complete, and up-to-date account information, including having an invalid or expired payment method on file, may result in your inability to access and use the services or Ambulance Seva’s termination of these terms with you. You are responsible for all activity that occurs under your Account, and you agree to maintain the security and secrecy of your account username and password at all times.
User Requirements and Conduct:
The service is not available for use by persons under the age of 18. You may not authorize third parties to use your Account, and you may not allow persons under the age of 18 to receive transportation or logistics services from Third Party Providers unless they are accompanied by you. You may not assign or otherwise transfer your account to any other person or entity. You agree to comply with all applicable laws when using the services, and you may only use the Services for lawful purposes (e.g., no transport of unlawful or hazardous materials). You will not, in your use of the services, cause nuisance, annoyance, inconvenience, or property damage, whether to the Third Party Provider or any other party. In certain instances you may be asked to provide proof of identity to access or use the services, and you agree that you may be denied access to or use of the services if you refuse to provide proof of identity.
Payment:
You understand that use of the services may result in charges to you for the services or goods you receive from a Third Party Provider. After you have received services or goods obtained through your use of the Service, Ambulance Seva will facilitate your payment of the applicable charges on behalf of the Third Party Provider as such Third Party Provider’s limited payment collection agent. Payment of the charges in such manner shall be considered the same as payment made directly by you to the Third Party Provider. Charges will be inclusive of applicable taxes where required by law. Charges paid by you are final and non-refundable, unless otherwise determined by Ambulance Seva. You retain the right to request lower charges from a Third Party Provider for services or goods received by you from such Third Party Provider at the time you receive such services or goods. Ambulance Seva will respond accordingly to any request from a Third Party Provider to modify the charges for a particular service or good.
All Charges are due immediately and payment will be facilitated by Ambulance Seva using the preferred payment method designated in your account, after which Ambulance Seva will send you a receipt by email. If your primary account payment method is determined to be expired, invalid or otherwise not able to be charged, you agree that Ambulance Seva may, as the Third Party Provider’s limited payment collection agent, use a secondary payment method in your account, if available.
As between you and Ambulance Seva, Ambulance Seva reserves the right to establish, remove and/or revise charges for any or all services or goods obtained through the use of the services at any time in Ambulance Seva’s sole discretion. Further, you acknowledge and agree that charges applicable in certain geographical areas may increase substantially during times of high demand. Ambulance Seva will use reasonable efforts to inform you of charges that may apply, provided that you will be responsible for charges incurred under your account regardless of your awareness of such charges or the amounts thereof. Ambulance Seva may sometimes provide certain users with promotional offers and discounts that may result in different amounts charged for the same or similar services or goods obtained through the use of the services, and you agree that such promotional offers and discounts, unless also made available to you, shall have no bearing on your use of the services or the charges applied to you. You may elect to cancel your request for services or goods from a Third Party Provider at any time prior to such Third Party Provider’s arrival, in which case you may be charged a cancellation/convenience fee.
This payment structure is intended to fully compensate the Third Party Provider for the services or goods provided. Any representation by Ambulance Seva to the effect that tipping is “voluntary,” “not required,” and/or “included” in the payments you make for services or goods provided is not intended to suggest that Ambulance Seva provides any additional amounts, beyond those described above, to the Third Party Provider. You understand and agree that, while you are free to provide additional payment as a gratuity to any Third Party Provider who provides you with services or goods obtained through the service, you are under no obligation to do so. Gratuities are voluntary. After you have received services or goods obtained through the service, you will have the opportunity to rate your experience and leave additional feedback about your Third Party Provider.
Use of Application:
You agree, undertake and confirm that Your use of the Application shall be strictly governed by the following binding principles:
1) You may use the Platform/ Application for lawful purposes only.
2) You shall not host, display, upload, modify, publish, transmit, update or share any information that: belongs to another person and to which You do not have any right to; or that interferes with another user's use and enjoyment of the Platform/Application or any other individual's use and enjoyment of similar services; or is harmful, harassing, defamatory, obscene, invasive of another's privacy, hateful, or ethnically objectionable, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatsoever, or unlawfully threatening or unlawfully harassing another user, the same being qualified to include behavior termed as "indecent representation of women" within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986,; or is misleading in any way; or is patently offensive to the online community, such as sexually explicit content or violates any third party's rights, including, but not limited to, intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person's name, email address, physical address or phone number) or contains restricted or password-only access pages, or hidden pages or images (those not linked to the Application or from another accessible page); or provides material that exploits people in a sexual, violent or otherwise inappropriate manner or solicits personal information from anyone; or provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses or contains video, photographs, or images of another person without his or her express written consent and permission, or the permission or the consent of his her guardian in the case of a minor; or tries to gain unauthorized access (as defined herein and in other applicable codes of conduct or end user access and license agreements) to the Platform/Application or to profiles, blogs, communities, account information, bulletins, friend request, or other areas of the Platform/ Application or solicits passwords or personal identifying information for commercial or unlawful purposes from other users; or engages in commercial activities and/or sales without our prior written consent, including activities such as contests, barter, advertising, or the buying or selling of "virtual" items.
3) Throughout these T&Cs, our "prior written consent" means a communication coming from our authorized representative, specifically in response to Your request, and specifically addressing the activity or conduct for which you seek authorization. You shall not copy, distribute or disclose any part of the Platform/Application in any medium.
4) You shall not attempt to interfere with, compromise the system integrity or security or transmissions to or from the servers running the Platform/Application.
5) You shall not take any action that imposes, or may impose, at our sole discretion, an unreasonable or disproportionately large load on our infrastructure.
6) You shall not collect or harvest any personally identifiable information, including account names, from the Platform/Application.
7) You shall not use the Application for any commercial purposes without having all necessary rights and licenses to the content available on the Platform/ Application.
8) You shall not impersonate another person or otherwise misrepresent your affiliation with a person or entity, conduct any fraudulent activity, hide or attempt to hide your identity.
9) You shall not access any content on the Platform/Application through any technology or means other than those capabilities provided by the Platform/Application.
10) You shall not bypass the measures we may use to prevent or restrict access to the Platform/Application, including without limitation features that prevent or restrict use or copying of any content or enforce limitations on use of the Platform/Application or the content therein.
11) You shall not probe, scan or test the vulnerability of the Platform/Application or any network connected to the Application nor breach the security or authentication measures on the application or any network connected to the Platform/Application.
12) You may not reverse look-up, trace or seek to trace any information on any other user of or visitor to the Platform/Application, or any other customer of Ambulance Seva, including any of our account not owned by you, to its source.
13) You understand that we have the right at all times to disclose any information (including the identity of the persons providing information or materials on the Platform/Application) as necessary to satisfy the Applicable Law, or valid governmental request. This may include, without limitation, disclosure of the information in connection with investigation of alleged illegal activity or solicitation of illegal activity or in response to a lawful court order or subpoena.
14) In addition, we can (and you hereby expressly authorize Us to disclose any information about you to law enforcement or other government officials, as We, in our sole discretion, believe necessary or appropriate in connection with the investigation and/or resolution of possible crimes, especially those that may involve personal injury.
15) We reserve the right, but have no obligation, to monitor the materials posted on the Platform/Application. We shall have the right to remove or edit any content that in our sole discretion violates, or is alleged to violate, any applicable law or the spirit or letter of these T&Cs. Notwithstanding this right of Ambulance Seva, YOU REMAIN SOLELY RESPONSIBLE FOR THE CONTENT OF THE MATERIALS YOU POST ON THE PLATFORM AND IN YOUR PRIVATE MESSAGES.
Cancellation policy:
Cancellation fee may be charged:
A) if You cancel after making a booking; or if a TSP cancels the ride after waiting at your location for more than 5 minutes.
B) You will not be charged a cancellation fee if the TSP is delayed by more than 30 minutes.
C) Luggage policy while using the service, You may not carry heavy luggage like suitcase, big bags etc. with you. However, you can carry handbags, backpacks etc.
Termination and expiry of the Account:
We reserve the right to modify, terminate or suspend the services to you at any time, without prior notice, due to any changes in our internal policy or the Applicable Laws or any breach of these T&Cs by You, or for any reason whatsoever. You can terminate your account by submitting a request to Us at support@ambulanceseva.com. We will make every effort to respond to your request for termination at the earliest. You will remain responsible for all transactions that occurred prior to termination of Your Account and have no outstanding.
Disclaimers: We do not warrant that:
1) The Platform/Application will be constantly available, or available at all; or The information on the Platform/Application is complete, true, accurate or non-misleading; or Any defects in the Platform/ Application will be corrected; or The Platform, Application; information, content, materials, product (including software) or services included on or otherwise made available to you through the application; their servers; or electronic communication sent from Us are free of viruses or other harmful components; or content on the Platform/Application constitutes, or is meant to constitute, advice of any kind.
2) You acknowledge that while Ambulance Seva employs certain quality control measures, Ambulance Seva does not, and cannot exercise control over the quality or safety of the transportation that is made use of by you from the TSPs, using the services.
3) Ambulance Seva will not be liable for any damages of any kind arising from the use of the service offered by the TSP including, but not limited to direct, indirect, incidental, punitive, and consequential damages.
4) Ambulance Seva will take all reasonable measures to ensure that TSP should fulfills his duty properly, but there may be exceptions, Ambulance Seva will not be held liable for any such compensation. The Customer is advised to make alternate arrangement in case the vehicle has not reached his/her location due to any reason.
5) The services, and any claim resulting from the same, while requested through the Application, remains the responsibility of the TSPs, and Ambulance Seva shall not be liable for any conduct of the TSPs.
6) Ambulance Seva encourages you to notify any complaints that you may have against any TSP that you may have hired using the Platform/ Application.
7) Ambulance Seva is not responsible for the conduct, whether online or offline, of any other user of the Application or Services.
8) You represent to Ambulance Seva that while using the service and during your journey in the vehicle, You shall
(a) behave in a disciplined and decent manner;
(b) refrain from disturbing, misbehaving with, or in any other manner adversely affecting the quality of the journey of the TSP; and
(c) not use any dangerous instrument or weapon against the TSP or harm them in anyway. In case of any non-compliance by you of the obligations hereunder, Ambulance Seva and/or the TSP shall have the right to terminate the ride immediately, without any liability whatsoever, and to initiate such other action as we deem fit or as permitted under Applicable Laws.
9) You shall ensure that: You share the pick-up location properly; You avoid talking loudly/shouting over the phone in the Vehicle; You do not use foul language in the Vehicle; You do not play music in the Vehicle and/or do any act which may cause any discomfort/inconvenience.
